On October 21, 2024, the Congress approved, in the second debate, file No. 23929, which aims to add a new section to Article 69 of the Labor Code.
With this change, it is intended to establish paid leave for the death of family members of workers, to protect the right to mourn, as follows:
- In the case of first or second-degree relatives by blood or collateral relationship, including mother, father, daughters, sons, grandmothers, grandfathers, grandchildren, sisters, and brothers, the worker will be entitled to one week of paid leave.
- The worker will be granted three days of paid leave in the event of the death of relatives in the first or second degree of affinity (father-in-law, mother-in-law, son-in-law, daughter-in-law, brother-in-law, or sister-in-law).
- Finally, a paid leave of two days will be granted in the case of the death of relatives in the third degree of consanguinity, collateral relationship, or affinity (great-grandmother, great-grandfather, great-granddaughter, great-grandson, uncles, aunts, nieces, nephews, aunts and uncles by marriage, nieces and nephews by marriage).
Currently, the only remaining requirement for it to come into effect is its signing as a Law of the Republic and its publication in the Official Gazette.
